Sir,

Sub: Illegal, unauthorized, unscientific MUNICIPAL SOLID WASTE MANAGEMENT (MSWM) operations at Kapuluppada Village – fatal violations of MSWM rules 2016 – endangering the human lives and environment at gross –humbly request for urgent orders and action to stop all the operations including construction of Waste to Energy (WTE) project and immediate restoration and rehabilitation of project site and surroundings - Reg.

Ref:  MSWM Rules, 2016 Ministry of Environment, forest and Climate change notification Dtd: 08^th April 2016 – S.O.1357 (E) -THE GAZETTE OF INDIA: EXTRAORDINARY (Part-II) – Sec. 3 (ii) - SOLID WASTE MANAGEMENT RULES, 2016 - Reg.

I, P.V.Giridhar, Advocate, Visakhapatnam, humbly complain as follows to your kind selves for an urgent action, in the interests of public at large, Global priorities and Initiatives for Environment.

The instant case pertains to current MSWM operations and projects, at Survey No. 410, Kapulluppada Village, Bheemunipatnam Mandal, Visakhapatnam District within the territories of GVMC.

That, this complaint is in response and with respect to grave grievances and serious hardships of public, people of downtrodden communities, economically weaker sections and personal approach of activists of human rights, environmentalists, civil liberties constitutional rights, liabilities and guarantees.

That, after careful review and throw reference and reflection, I find it very urgent and utmost important to draw the attention of your kind selves towards the most devastating operations and projects of MSWM at Kapullupada Village.

PURPORTED ISSUES AND OPERATIONS

1.     Waste to Energy Power Plant (WTE).

2.     Scientific Land Fill (SLF).

3.     Bio-Medical Plant.

4.     Composting.

5.     Bio-Mining (please refer to the report from your office by CMOH Dtd: 03-05-2018 in response to Lr. C/GVMC/SWM/VSP/006/2018, Dtd: 16-03-2018).

AVERMENTS AND VIOLATIONS - THEIR CAUSE AND EFFECTS

1.     Prima-facie the unscientific, unauthorized and illegal dumping of un-segregated Bio, Industrial, Medical, E-waste and hazardous MSW at Survey No. 410, Kapulluppada Village, Bheemunipatnam Mandal, Visakhapatnam District, is causing most dreadful effects and impact on human health and has become fatal and threat to the environment at gross which was already brought to your notice through the letter bearing the numberLr. C/GVMC/SWM/VSP/006/2018, Dtd: 16-03-2018and no action has been taken till date. No efforts are being made at least to control the flames and smoke rising from the dumps and worsen than that is, it is informed by your authority that the flames will be controlled by spraying water which would be even more hazardous which leads to more formation of leachate which is soluble in many substances. As the soil of that area is porous it can easily reach the ground water table and contaminates it with poisonous chemicals. Leachate that retains in soil not only kills but also  bio accumulates in various micro organisms and plants, escapes in to air by evaporation andpollutes the air, enters into the tissues of animals, birds, insects and other species which are living and feeding on waste and finally it will enter the food chain causing measurable and irreparable loss to humans. In this regard I have a modest suggestion that, it is better in the interests of public to consult authorized scientific institutions for remedies instead of basing on the application of fourth class minds.

2.     No action has been taken to control stray swine and other animals that are feeding in dumping yard which would be ‘blood bath’ for animals, humans and other organisms. Already the world witnessed the epidemic of swine flu (Japanese Encephalitis). Andhra Pradesh, inparticular  Srikakulam, Vizianagaram and Visakhapatnam Districts suffered severely by that disastrous Flavivirus. The epidemic brutally ripped the lives of innocent children and pushing many people into abyss of trauma.

It is not difficult to prevent and control the disease as its hosts and broodersare very limited and within the control of humanhands. Still, we have failed because of gross negligence, recklessness, absence of due diligence, dereliction of duty, resentfulness and corruption. It should be understood and it should be made to understand that the responsibilitywill not be found in mere reports, documents and rules, but, rather, enforcement, implementation, execution, observation, maintenance, watch & ward and ultimately practice.

3.     That, other activities are not commenced yet and which are subject to consent, permission and approval from various authorities except WTE and Land Fill (SLF).

4.     Pre feasibility reports, DPRs and consent for establishment of WTE and Scientific land fill are mere desk work and gathered information from public domains and there is no evidence of real works carried in the field level which is evidenced by many documents from their reports submitted to various authorities. The actual state and condition of existing MSW dump and current dumping process is utterly suppressed and intentionally concealed and reports submitted to various departments, authorities in connection with environmental and various approvals are false and fabricated.

5.     The whole activity of MSWM at Survey No. 410 Kapulluppada Village, Bheemunipatnam Mandal, Visakhapatnam District, isnot in tune with the existing Master Plan of VUDA @ VMR vide G.O.Ms No. 345, MA&UD Department. Dtd: 30-06-2006.

6.     Land Use Conversion is not carried and even not bothered, which plays a vital role in environmental issues in connection with domestic and International treaties.

The Layout Plan was not categorized and there is no approval of layout plan for the activity which is one of the most essential requisites of Environmental Consent EC).

7.     Building regulations as per G.O.Ms No. 168, MA & UD (M) Dept., Dt.07-04-2012 and other succeeding G.O.s, IRC, BIS and NBC mandates are simply over thrown like a piece of scrap.

8.     I, once again strongly and firmly allege that, the activity at gross, including constructions what so ever are illegal and liable for immediate halt.

THE EXISTING MSW AND ITS CONDITION AT KAPULLUPADA

The existing MSW is being exposed to all kinds of weather conditions since a very long period. Various hazardous wastes from medical, bio medical, hospital, industrial, electronics and other materials like polymers, plastics and synthetics are indiscriminately mixed in the waste and now they are inseparable even by BAT (Best Available Technology).

Some MSW is decayed partially for certain levels and some waste took various forms due to various reactions. They are being burned for a long period and they turned into dangerous material which will not respond to any natural or artificial termination or destruction.

Hence, the incineration or land fill or any other use of current, existing MSW present in the yard will be most hazardous and fatal to the humans, other organisms and environment at whole.

If that MSW is used for incineration @ combustion or land fill, it emits enormous levels of toxics containing Dioxins, furans and Dioxin like substances i.e., PCDDs, PCDFs, POPs, please refer PARIVESH – Dioxin (PCDDs) and Furan (PCDFs) – critical Persistent Organic Pollutants (POPs) – V.Rajagopalan, Chairman – Central Pollution Control Board, Ministry of Environment, Forests and Climate Change.

Combustion processes are the main source of Dioxin and furan emissions globally. Out of the known sources of Dioxin contamination, more than 95% emissions are derived from combustion process. Dioxin and furan are formed from the thermal breakdown of organic materials combined with transitional metals and chlorinated compounds. It is also known that Dioxins are chemically formed at temperature above 200^oC but completely destroyed at 800^o C. Reformation of Dioxin occurs, when the temperature lies between 200^o C to 400^o C. Chlorine availability and process temperature are the two important factors responsible for Dioxin formation.

It is a proven fact that, Dioxin exposure is responsible for developing breast cancer in women and reduced sperm count in men. Organic chemicals like PCBs, PCDDs, PCDFs, are known as “GENDER BENDER”. Long – term exposure is linked to the  impairment of immune system, nervous system, endocrine system and reproductive functions. Long-term exposure even to low concentration of Dioxin, alters the reproductive functions including infertility, miscarriage, spontaneous abortion, congenital anomalies, and neonatal developmental abnormalities.

Therefore, I request your learned selves to take urgent action to stop all the activities including waste to energy and scientific land fill, use of existing MSW and primarily the shifting of dumping of MSW to other place as per the regulations of Ministry of Environment and Forest 2016 Rules.

A hard copy and scanned soft copies one in E-HDD, one in S-HDD, one in E-Mail Copy, of this notice are kept in my office for further reference and proceedings.

        స్వచ్చ భారత్ మిషన్ మరియు MSWM రూల్స్ 2016 ప్రకారం (MSW) మునిసిపల్ సాలిడ్ వేస్ట్  (మునిసిపల్ ఘన వ్యర్ద నిర్వహణ) తడి, పొడి మరియు మెడికల్ ఇతర వేస్ట్ లు అనగా చెత్తలు విడివిడిగా సేకరించి, విడివిడిగా కుప్పలు పోసి, వెంటనే వాటియందు గల వివిధ చెత్తలను MSWM 2016 చట్టం ప్రకారం వర్మి కంపోస్ట్ తయారీ, బయో మెడికల్ ప్లాంట్, సైంటిఫిక్ ల్యాండ్ ఫిల్ మరియు వేస్ట్ టు ఎనర్జీ (WTE) ప్లాంట్ లకు తరలించవలసి ఉంటుంది.

        కానీ, GVMC మాత్రం స్వచ్చ భారత్ మిషన్ మరియు MSWM 2016 మార్గదర్శకాలను తుంగలోకి త్రొక్కి, చెత్తలన్నీ కలబోసి అన్ని రకాల వ్యర్ధములను ఒకే దగ్గర కుప్పలు వేసి కాపులుప్పడ ప్రాంతాన్ని అత్యంత ప్రమాదకరంగా మార్చి GVMC విశాఖపట్నం పై కాలుష్యం రూపంలో మృత్యు ద్వారములు తెరిచింది.

        రోజుల కొలదీ తడి చెత్త నిలువ వలన లీచేట్ అనే ద్రావకం బురద రూపంలో నిలువ వుండి, దోమలకు నెలవై, పర్యావరణానికి ప్రమాదకరంగా తయారైనది. మొక్కల కుండీలలో మరియు ఫ్రిజ్ ల క్రింద నిలువ ఉండే పది పదిహేను చుక్కల నీళ్ళ గురించి ప్రజలకు జాగ్రతలు చెప్పే GVMC వారి డంపింగ్ యార్డ్ లో నిలువ ఉన్న భారీ మురుగు గురించి మాత్రం నోరు మెదపదు, చెత్తలను వేరు చేయరు, తుప్పల జోలికి పోరు, ‘అది వారి సోమరి తనం అనుకుంటున్నారా?’ కానే కాదు! మరి దేనికోసం అలా చేస్తున్నారో అసలు నిజాలు తెలిస్తే ప్రజలు ఒక్కసారి ఉల్లిక్కి పడి గుండెలు బాదుకుంటారు.

        చట్టాలను కాల రాయడానికి కారణం అక్రమంగా పందులు పెంపకం. పందుల జీవన క్రమం బట్టి సమృద్దిగా బురద మరియు ఆహారం కావాలి, వాటిని ఆ రకంగా పట్టణ పరిధిలో పెంచడానికి అనుమతులు లేవు. కానీ పందుల పెంపకం చాలా లాభదాయకమైనది. అందువలన, పందులు పెంచే వారితో కుమ్మకై వారి అక్రమ, చట్ట వ్యతిరేక వ్యాపార లావాదేవిలతో చేతులు కలిపి విచ్చలవిడిగా ఎటువంటి పెట్టుబడి మరియు ఖర్చులు లేకుండా పందులను పెంచి వాటిపై నెల నెలా లక్షల రూపాయలు దండుకుంటున్నారు. సదరు అవినీతి సొమ్ము కోసం ప్రజల ప్రాణాలను పణంగా పెడుతున్నారు.

        ఇక ఆ చెత్త కుప్పలని అలాగే ఉంచి వాటిని తగల బెట్టి ఘాటైన భయంకరమైన పొగలతో ప్రజల ప్రాణాలతో చలగాటమాడుతూ పర్యావరణాన్ని సర్వనాశనం చేయడానికి కారణం అక్రమ స్క్రాప్ మార్కెట్ వారితో చేతులు కలపడం.

        చైల్డ్ లేబర్, ఇంకా పసి పిల్లల నుంచి ఆడవాళ్ళు ముసలి వాళ్ళతో పని చేయించి వారి రక్తం నుండి డబ్బు పిండుతూ, ప్రజా ఆరోగ్యానికి పొగ పెడుతున్నారు.

        సదరు పొగలకు తోడు వేస్ట్ టు ఎనర్జీ ప్లాంట్, ల్యాండ్ ఫిల్ అని రెండు ప్రాజెక్ట్లులు ప్రారంభించుచున్నారు. వీటికి ఆ పొగలు, వాయువులు కూడా తోడైతే ఇక విశాఖపట్నానికి మరణ మృదంగమే.

        సదరు వాయువుల నుండి డయాక్షిన్ మరియు ఫ్యురేన్ అనే రసాయనాలు వెలువడతాయ్ వాటి వలన బ్రేస్ట్ కాన్సర్, ఎబార్షణ్, స్పెర్మ్ కౌంట్ తగ్గిపోవుట ఇంకా ఎన్నో జబ్బులు సోకటమే కాకుండా ఆఖరికి తల్లి పాల యందు కూడా విషపూరిత రసాయనాలు చేరి ముక్కు పచ్చలారని పసిపిల్లలపై తీవ్ర దుష్పరిణామములు కలుగుతాయి.

        అందువలన MSW డంపింగ్ కార్యక్రమములు సర్వే నెంబర్ 410 మరియు 415 కపులుప్పాడ గ్రామముయందు తక్షణమే నిలిపి వేసి పర్యావరణ శాఖ, VMR మాస్టర్ ప్లాన్ మరియు సంబందిత ఇతర శాఖల అనుమతులు తీసుకొని శాస్త్రీయ పద్దతిలో సదరు కార్యక్రమములు వేరే ప్రదేశము యందు నెలకొల్ప వలసినదిగా మరియు వెంటనే చెత్త తగలబెట్టుట ఆపి పందులు ఇతర పశువులు చేరకుండా తక్షణమే తగిన చర్యలు తీసుకోవలసినదిగా డిమాండ్ చేస్తూ లేని యెడల చట్ట పరమైన చర్యల ద్వారా వాటిని నిరోదిస్తామని GVMC కి పత్రికా ముఖముగా తెలియజేస్తున్నాం.
